A short agreement.
By using everysong, you agree to these terms. If you don't agree, please don't use the service. We'll keep this short.
What you get
A one-time $5 payment unlocks access to the everysong readout tool for the life of the product (or the life of your account, whichever is shorter). You can upload audio files, receive trait analyses and similar-track matches, and access your results via permalinks. Unlimited uploads subject to reasonable use (currently 50 readouts per day — we'll raise this as infrastructure allows).
What you must not do
- Upload audio you don't have the right to use
- Attempt to scrape, bulk-download, or reverse-engineer the catalog
- Use the service to attack, overload, or probe our infrastructure
- Share your account with more than a couple of people (it's $5 — buy another one)
- Use the service for anything illegal in your jurisdiction
Content you upload
You retain all rights to any audio you upload. We do not claim ownership of anything. As described in our privacy policy, we delete the original audio within ~30 seconds of analysis — we only retain the numerical trait outputs and embedding.
Creative Commons catalog — how it works, what you're responsible for
Our match results are drawn from third-party catalogs of Creative Commons-licensed tracks (primarily Jamendo and the Free Music Archive). For each match we display: the track title, the artist name, the license as it appeared at the source when we indexed the track, and a link back to the original source URL.
What we do:
- Index publicly available Creative Commons tracks from trusted sources
- Compute numerical trait values and an embedding for each track
- Display the license metadata exactly as the source presents it — we do not relabel or interpret
- Link back to the original source so you can verify and download from there
What we don't do:
- We do not host, stream, mirror, or redistribute audio files
- We do not warrant that the license shown is still accurate — licenses can be changed, revoked, or were occasionally mislabeled at the source
- We do not police what users do with matched tracks
What you must do: before using any matched track in your own work (commercial or personal), click through to the source URL and independently verify:
- The license is still active and unchanged
- The license terms actually permit your intended use (CC BY-NC does not allow commercial use; CC BY-SA requires your derivative to share the same license; etc.)
- The attribution requirements for that specific license variant
Use of any matched track is at your sole risk and responsibility. We provide trait data and license metadata as a research and discovery tool — not as a legal clearance service. If the source site removes a track or changes its license, we may not reflect that immediately in our index.
If you are an artist whose track is in our index
If you believe a track of yours is indexed in error, or its license has changed, email [email protected] with the source URL and we will remove it from the index within 48 hours. No questions asked.
Accuracy
We label every trait GREEN, AMBER, or RED according to how reliable we think it is. Even GREEN traits are not infallible — they're computed by open-source audio ML models that make mistakes. Don't use everysong as the sole source of truth for anything important (royalty splits, copyright claims, etc.). If a trait is clearly wrong for a given track, tell us and we'll investigate.
Availability
We try to keep the service up, but we don't guarantee uptime. We're a small operation. Scheduled downtime, outages of our underlying services (Fly.io, Cloudflare, Stripe), and occasional bugs are all possible. We won't offer service credits for downtime — if the tool stops working in a way that makes it unusable for you, email us for a refund.
Changes
We may update these terms. If we make a material change (e.g. scope of the product, price), we'll email every paid user. Continued use after a change means you accept the updated terms.
Shutting down
If we decide to shut everysong down permanently, we will (a) email all users at least 30 days in advance, (b) open-source the analysis code, and (c) provide a data export. We'll also stop accepting new payments immediately.
Liability
To the maximum extent permitted by law, our total liability to you is limited to the amount you paid us — which is $5. We provide the service "as is" and disclaim all warranties.
Governing law
These terms are governed by the laws of the Netherlands. Any disputes will be resolved in the competent courts of the Netherlands. If you are a consumer residing in the European Union, nothing in these terms deprives you of the protections of mandatory local consumer law.
